New Delhi: The Delhi High Court, which was making oral comments on the situation of the Delhi government due to the arrest of Delhi Chief Minister Arvind Kejriwal, on Monday made them a part of the order. While making arrangements for the expenses of books, stationery etc. of the new session for the children of MCD schools, the court said, Kejriwal’s decision to remain on the post of CM is personal. Their absence cannot become a hindrance in the education of school children. This is the constitutional and statutory right of school children. The MCD Commissioner should immediately bear the necessary expenses for these responsibilities without being constrained by the limit of Rs 5 crore. Disagreeing with the arguments of the Delhi government, the court said, it is not right to say that important decisions cannot be taken during the code of conduct. Policy decisions could not be taken but people holding constitutional posts have to take important decisions every day. Delhi government has come to a standstill after Kejriwal’s arrest. Leave aside the capital, the post of CM of any state is not a formal post. The person in charge here has to be available 24 hours. The application states that due to administrative hurdles, there is a lack of basic facilities for about two lakh students.

Kejriwal’s continuation on the post of CM despite his arrest is a personal decision, but national interest and public interest both demand that the person holding this post should not remain absent indefinitely.

SC asked- Why was the bail application not filed?
During the hearing on the petition against the arrest of Delhi CM Arvind Kejriwal, the Supreme Court asked why you did not file the bail application in the trial court? Kejriwal has challenged his arrest and remand in the Supreme Court. He has said that the arrest is illegal. The statement on the basis of which the arrest has been made was taken one and a half years ago and I have been arrested after the implementation of the code of conduct. There is no evidence against me. Kejriwal is currently in jail on charges of money laundering related to Delhi Excise Policy. Abhishek Manu Singhvi appeared before the Supreme Court on behalf of Kejriwal. During this, the Supreme Court asked why you did not file a bail application before the trial court? Singhvi said, there were many reasons for this and one of those reasons is that Kejriwal’s arrest is illegal. This is a violation of Section 19 of the PMLA Act.

Senior Aam Aadmi Party leader and Delhi government minister Atishi met Delhi Chief Minister Arvind Kejriwal in Tihar Jail on Monday. After the meeting, while talking to the media outside the jail, Atishi said that even in jail, Arvind Kejriwal is not worried about himself but about the two crore people of Delhi. Throughout the meeting, the CM took updates about the education of children studying in Delhi government schools and treatment arrangements in Mohalla clinics. Also, being the Water Minister, the CM directed him to ensure that there is no water shortage in Delhi during summers and people do not have to face any kind of problem regarding water. On the other hand, Sunita Kejriwal also met her husband and CM Arvind Kejriwal in jail. On Sunday, AAP leaders had said that the jail administration has canceled the request to meet Sunita Kejriwal. She will not be able to meet the CM but on Monday morning party sources said that Sunita has also been allowed to meet.
