New Delhi. The Election Commission of India (ECI) on Thursday told the Supreme Court that allegations of an extra vote appearing in the ‘Electronic Voting Machine’ (EVM) during the voting exercise in Kasaragod, Kerala are false. The Supreme Court was hearing petitions in which it was requested to completely verify the votes cast through EVMs through ‘Voter Verifiable Paper Audit Trail’ (VVPAT). In this case, the Supreme Court has reserved its decision after hearing the arguments of all the parties. While the Election Commission argued that EVMs are completely safe, the court also commented that one cannot distrust everything.

During the hearing of the case, the Election Commission told the Supreme Court that EVM is an independent machine. It cannot be hacked or tampered with. Not only this, there is no need to redesign VVPAT. The Commission said that the possibility of human error in manual counting cannot be ruled out. But in the current system human participation has become minimal. On this, Supreme Court Justice Khanna said that the voter will have to be satisfied with the explanation given by the ECI. The Evidence Act also states that official acts are generally presumed to have been done lawfully.

SG Tushar Mehta argued in the Supreme Court that such petitions come from time to time on the eve of elections. This affects the voting percentage and harms democracy. Earlier in the day, the apex court had asked senior advocate Maninder Singh, appearing for the Election Commission, to consider the issue. Advocate Prashant Bhushan had raised this issue. Bhushan, appearing for petitioner NGO ‘Association for Democratic Reforms’, told the court that there were reports that the EVMs were showing an extra vote during the ‘mock poll’ exercise.
